Terms of Service

The boundary of what Dwize promises, the eight covenants we operate under, and what happens at year-end. Plain English, not lawyer theatre.

1. The Care Year contract

Every Dwize sale is a 12-month operating contract called the Dwize Care Year. You are buying a year of operations, not a launch handoff. The artifact (Site, App, Store, Brand, or Suite) is what is delivered inside that year.

2. The eight covenants

These are the operational commitments that govern every Care Year. They are not aspirations — they are written into the contract appendix and we honor them.

  1. Same-price renewal. Year 2 = Year 1. No annual hike, ever.
  2. Two-day update. Any in-scope content update is live within 2 business days of receipt.
  3. Two-hour acknowledgement. Every inquiry from a Care Year customer is acknowledged within 2 business hours during business days.
  4. Named operator. Every Care Year has one assigned human at Dwize. Their WhatsApp is in your contract.
  5. Monthly check-in. Even if you are silent, Dwize reaches out at least monthly with a status update and one question.
  6. 99.95% uptime. Measured monthly. If we miss it, a credit goes to your next renewal automatically.
  7. Honest 30-day out. If at any point in the first 30 days you are not satisfied, we refund pro-rata and offboard cleanly.
  8. No-lock-in handover. At year-end, if you do not renew, we provide code/content export, DNS instructions, and 30 days of read-only hosting.

3. What's in scope

Each product page (Site, App, Store, Brand, Suite) lists its included scope explicitly. Anything not listed is out of scope.

  • Hosting and infrastructure for the year.
  • Maintenance: security patches, dependency updates, OS-version compatibility (App / Brand).
  • 12 monthly content updates within 2 business days each.
  • Bilingual WhatsApp + email support from your named operator.
  • Annual technical review with recommendations.

4. What's out of scope

  • Unlimited custom development. Beyond-scope work is quoted as Suite or Custom Hours.
  • Paid ads media spend. Optional Search Year / Ads Year retainers cover ad management; the spend is yours.
  • Photography and copywriting production. Partner-fulfilled, Dwize-coordinated.
  • Beyond-scope structural rebuilds within the year. Re-quoted.
  • Revenue or ranking guarantees. Outside our control; we don't promise what we don't control.

5. Pass-through costs

Some real third-party costs are listed separately at cost (not Dwize revenue):

  • Domain name and SSL: ~₹2,100/year.
  • Apple Developer Program: ~₹9,000/year (App / Brand).
  • Google Play Console: ~₹2,100 one-time (App / Brand).
  • Paid ad media spend, when an Ads Year is engaged.

6. Ownership

You retain 100% ownership of your brand, domain, content, and customer data. Dwize retains the underlying platform code (cannot be transferred). Custom-built Suite components — code ownership terms are agreed in the Suite contract specifically.

7. Renewal

Sixty days before year-end you receive a renewal preview. Same-price renewal applies if you stay at the same product tier. Upgrade gets a 25% loyalty credit toward the new tier. If you do not renew, covenant 08 governs the handover.

8. Cancellation and refunds

Covenant 07: pro-rata refund within first 30 days, no questions. After 30 days, the year is committed and the price stands; we continue operating per the covenants. You can elect not to renew at any point — covenant 08 applies.

9. Liability

Dwize's aggregate liability for any single Care Year is limited to the fees paid by you for that Care Year. We do not accept liability for indirect loss, lost revenue, or business interruption beyond what the uptime SLA covenant covers.

10. Force majeure

Events outside Dwize's reasonable control (regulatory action, force majeure, third-party platform failures including Apple/Google policy changes that retroactively reject your app) are not Dwize liabilities, but we keep operating in good faith and communicate transparently.

11. Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Bikaner, Rajasthan, India.

12. Updates to these terms

We refresh these terms when we materially change how Dwize operates. Material changes are notified to active Care Year customers by email at least 30 days before they take effect, and do not retroactively reduce existing covenants.
